The bottom line is that current laws criminalize every teen to ever send nudes, and do very little to stop actual child molesters, who simply form insular little cells that resist police infiltration. If anything, driving them underground has created a very evasive, very stealthy black market. In the near future, it may also criminalize witnesses of sex crimes through wearable devices like Google Glass.
Additionally, the intentions of the defendant are not considered under current US laws, similar to possession of some hard drugs. Accidental possession, images or videos of your underaged self, and even people trying to report CP have been convicted of it on this technicality. Many cases in the US never go to a jury due to judge-arbitrated bench trials and plea bargaining to lesser charges.
More importantly, there are political reasons these useless laws are still on the books: they’re so vaguely phrased that they can be used to justify new, harsher laws. That could include anything from restrictive copyrights to government surveillance and literal censorship of anything deemed CP-related or CP-enabling. Arguably, this is already happening in some European laws.
Right now, if somebody emails you CP, you are guilty of a felony even if you didn’t ask for it. That’s a law that needs to be changed.
